Application Security Standards (“Site”) (https://appsecuritystandards.org) is an independent editorial publication, vendor directory, and industry resource covering application security, software supply chain security, secure software development, and related cybersecurity topics.

The Site is operated by Accessibility.com, LLC.

By accessing or using the Site, creating an account, submitting information, purchasing services, subscribing to vendor offerings, or otherwise interacting with the Site, you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, do not access or use the Site.

1. Eligibility

The Site is intended for individuals who are at least 18 years old.

By using the Site, you represent and warrant that:

·       you are at least 18 years old;

·       you have the authority to enter into these Terms;

·       information you provide is accurate and current;

·       your use of the Site complies with applicable laws and regulations.

2. Description of Services

Application Security Standards provides:

·       editorial and educational content;

·       cybersecurity news and analysis;

·       vendor directories and listings;

·       sponsored resources and campaigns;

·       webinars, reports, and gated content;

·       lead generation and vendor-introduction services;

·       account and subscription services;

·       related industry resources and communications.

Certain portions of the Site may be sponsored, promotional, vendor-supported, or advertising-related.

The Site may modify, suspend, discontinue, or change any feature, functionality, offering, or service at any time without liability.

3. Accounts and Registration

Certain features require account registration.

Users are responsible for:

·       maintaining account confidentiality;

·       restricting unauthorized access to accounts;

·       activities occurring under their accounts;

·       maintaining accurate account information.

We reserve the right to suspend, restrict, remove, or terminate accounts at our discretion, including for:

4. Vendor Listings and Submissions

Vendors may submit, manage, edit, or request updates to listings, profiles, materials, resources, campaigns, webinars, advertisements, and related content.

By submitting content to the Site, vendors represent and warrant that:

·       they own or have the right to use submitted materials;

·       submitted materials do not infringe third-party rights;

·       submitted information is accurate and not misleading;

·       submitted content complies with applicable laws and regulations.

We do not guarantee that vendor-submitted content will be reviewed, verified, monitored, or approved prior to publication.

We reserve the right to:

·       edit, refuse, reject, suspend, remove, or modify content;

·       remove listings or profiles;

·       restrict visibility;

·       terminate vendor participation;

·       decline publication requests;

·       modify directory structure or categorization;

·       remove materials we determine are inaccurate, inappropriate, misleading, unlawful, harmful, or inconsistent with Site operations.

Directory inclusion does not constitute endorsement, certification, verification, recommendation, or approval.


5. Sponsored Content and Lead Generation

The Site may publish sponsored content, gated resources, webinars, downloads, campaigns, and promotional materials associated with vendors, advertisers, sponsors, or industry partners.

When users submit forms, request resources, register for webinars, download materials, or otherwise engage with sponsored or vendor-related content, information submitted may be shared with the sponsor, vendor, advertiser, or partner associated with that content or campaign.

The Site does not guarantee:

·       lead quality;

·       lead accuracy;

·       lead conversion;

·       purchasing intent;

·       engagement rates;

·       exclusivity;

·       sales outcomes;

·       minimum lead volume;

·       marketing performance;

·       revenue generation.

Unless expressly agreed in writing, leads and related interactions are provided on an “as-is” basis.

Vendor follow-up activities, communications, transactions, negotiations, or relationships are solely between the applicable parties.

We are not responsible for:

·       vendor conduct;

·       user conduct;

·       third-party communications;

·       purchasing decisions;

·       contractual disputes;

·       lead validity;

·       customer acquisition outcomes;

·       advertising performance;

·       campaign effectiveness.


6. Editorial Independence

Application Security Standards maintains editorial independence.

Advertising, sponsorships, vendor participation, directory inclusion, paid placements, or commercial relationships do not guarantee:

·       editorial coverage;

·       favorable treatment;

·       rankings;

·       reviews;

·       recommendations;

·       publication decisions.

Editorial decisions remain solely within the discretion of the Site and its operators.

The Site may publish opinions, analysis, reporting, commentary, industry perspectives, or vendor-related information that vendors or third parties may disagree with.


7. Payments, Billing, and Subscriptions

Certain services, subscriptions, listings, sponsorships, campaigns, and vendor features require payment.

Vendor subscriptions may renew automatically unless canceled in accordance with applicable subscription terms.

Vendors may cancel subscriptions with at least 30 days notice.

Unless otherwise agreed in writing:

·       fees are non-refundable;

·       payments are final;

·       partial billing-period refunds are not provided;

·       cancellation does not eliminate outstanding payment obligations.

Following cancellation, vendors may retain access through the remainder of the active paid billing period unless access is terminated earlier for violations of these Terms or operational reasons.

Failed or declined payments may result in:

·       suspension of services;

·       removal of listings;

·       restriction of access;

·       cancellation of campaigns;

·       account termination.

We may use third-party payment processors, including Stripe.

Use of third-party payment providers is subject to the provider’s own terms and policies.


8. Acceptable Use

Users may not:

·       violate applicable laws or regulations;

·       submit false or misleading information;

·       engage in spam, scraping, or abusive activity;

·       interfere with Site operations or security;

·       distribute malware or harmful code;

·       attempt unauthorized access;

·       infringe intellectual property rights;

·       impersonate others;

·       use the Site for unlawful, deceptive, or harmful purposes.

We may investigate suspected violations and take action at our discretion.


9. Intellectual Property

The Site, including its content, branding, design, text, graphics, software, layout, editorial materials, databases, and related assets, is owned by Accessibility.com, LLC or its licensors and is protected by intellectual property laws.

Except as expressly permitted, users may not:

·       scrape or systematically extract Site materials.

Limited personal, non-commercial use is permitted solely for lawful informational purposes.

Vendor trademarks, logos, and brand assets remain the property of their respective owners.

Certain visual assets, illustrations, or images on the Site may be digitally generated, enhanced, modified, or licensed from third-party sources.


10. Third-Party Content and Services

The Site may contain:

We do not control or guarantee third-party content, products, services, or websites.

Interactions with third parties are solely between the applicable parties.

We are not responsible for:

·       vendor claims;

·       security practices;

·       privacy practices;

·       software performance;

·       transactions or disputes;

·       damages arising from third-party interactions.


11. Disclaimers

THE SITE AND ALL CONTENT, SERVICES, MATERIALS, LISTINGS, CAMPAIGNS, RESOURCES, AND FEATURES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF:

·       MERCHANTABILITY;

·       FITNESS FOR A PARTICULAR PURPOSE;

·       NON-INFRINGEMENT;

·       ACCURACY;

·       SECURITY.

We do not guarantee:

·       uninterrupted availability;

·       error-free operation;

·       accuracy of vendor claims;

·       completeness of content;

·       cybersecurity outcomes;

·       regulatory compliance;

·       business results;

·       marketing results;

·       lead performance.

Users rely on Site materials and vendor information at their own risk.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCESSIBILITY.COM, LLC, APPLICATION SECURITY STANDARDS, AND THEIR AFFILIATES, OWNERS, EMPLOYEES, CONTRACTORS, LICENSORS, PARTNERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

·       INDIRECT DAMAGES;

·       INCIDENTAL DAMAGES;

·       CONSEQUENTIAL DAMAGES;

·       SPECIAL DAMAGES;

·       PUNITIVE DAMAGES;

·       LOSS OF PROFITS;

·       LOSS OF DATA;

·       BUSINESS INTERRUPTION;

·       LOSS OF REVENUE;

·       REPUTATIONAL HARM;

·       PROCUREMENT COSTS;

·       DAMAGES ARISING FROM THIRD-PARTY INTERACTIONS;

·       DAMAGES RELATED TO VENDOR RELATIONSHIPS OR LEADS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID TO US BY THE APPLICABLE USER OR VENDOR DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply in all circumstances.


13. Indemnification

Users and vendors agree to defend, indemnify, and hold harmless Accessibility.com, LLC, Application Security Standards, and their affiliates, owners, employees, contractors, licensors, and partners from claims, damages, liabilities, losses, costs, and expenses arising from:

·       use of the Site;

·       submitted materials or content;

·       vendor claims or representations;

·       violations of these Terms;

·       violations of applicable laws;

·       infringement claims;

·       disputes with third parties.


14. Governing Law and Venue

These Terms are governed by the laws of the State of Rhode Island, without regard to conflict-of-law principles.

Any dispute arising from or relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in Rhode Island.

Users and vendors consent to the exclusive jurisdiction and venue of those courts.

The prevailing party in any action or proceeding arising from these Terms shall be entitled to recover reasonable attorneys’ fees, costs, and expenses.


15. Class Action Waiver

To the maximum extent permitted by law, users and vendors agree that claims shall be brought solely in an individual capacity and not as part of any class action, consolidated action, collective action, representative action, or similar proceeding.


16. Changes to These Terms

We may modify or update these Terms at any time.

Changes become effective upon posting unless otherwise stated.

Continued use of the Site following updated Terms constitutes acceptance of the revised Terms.

Users should review these Terms periodically.
