You're Probably Misreading Article 5 of the EU AI Act

Article 5 of the EU AI Act went into enforcement in February 2025, and compliance teams are scrambling. The issue isn't that the prohibitions are unclear—the European Commission published detailed guidelines on February 4, 2025. The problem is that teams are treating Article 5 like a checklist when it's actually a minefield of context-dependent judgments.

The stakes are high: fines can reach up to €35 million or 7% of global annual turnover. But the bigger risk isn't the penalty—it's discovering mid-deployment that your AI system crosses a prohibition you didn't recognize.

Here's why teams keep getting this wrong, and how to fix it before your next release.

Why These Mistakes Keep Happening

Article 5 prohibits eight specific AI practices, but the language is principle-based, not technical. Terms like "manipulative techniques," "exploiting vulnerabilities," and "social scoring" require interpretation. Your legal team reads them as policy constraints. Your engineering team reads them as implementation rules. Neither perspective is complete.

The EU AI Act uses a risk-based framework, which means the same technical capability can be compliant in one context and prohibited in another. A recommendation engine that surfaces content based on user behavior isn't inherently problematic. That same engine becomes a violation if it exploits psychological vulnerabilities to manipulate decision-making.

Most teams don't have a process to bridge this gap between legal interpretation and technical implementation. They're either over-relying on legal review (which slows everything down) or under-relying (which creates compliance debt).

Mistake 1: Treating Prohibitions as Binary Technical Rules

Why it happens: Engineers want clear boundaries. "Does this model use biometric data?" feels answerable. "Does this system exploit vulnerabilities of a specific group of persons?" does not.

The consequence: You build guardrails around the wrong things. Consider a chatbot designed for elderly users that adjusts its language complexity based on interaction patterns. Is this adaptive UX or exploitation of age-related vulnerabilities? The answer depends on intent, deployment context, and whether the adaptations serve the user's interests or the provider's commercial goals.

The fix: Map each prohibition to your system's actual behavior, not its technical components. For each AI capability, document:

  • What decision or outcome it influences
  • What user characteristics it considers (explicitly or implicitly)
  • Whether it creates asymmetric information or power dynamics
  • How users can understand or contest its operation

This isn't a one-time exercise. Your AI system's risk profile changes when you deploy it in a new market, integrate new data sources, or modify its objective function.

Mistake 2: Assuming Your Monitoring Catches Prohibited Behavior

Why it happens: Teams extend their existing observability stack to AI systems and assume they're covered. They track model accuracy, latency, and error rates—all important, but none of them detect Article 5 violations.

The consequence: Your monitoring tells you the system is working as designed. It doesn't tell you the design itself is prohibited. A social scoring system that accurately ranks individuals based on behavior or personality traits is still a violation, regardless of technical performance.

The fix: Build compliance-specific monitoring that tracks behavioral patterns, not just technical metrics. You need visibility into:

  • What features your model weights most heavily in decision-making
  • Whether those features correlate with protected characteristics
  • How outputs vary across user segments
  • Whether the system's influence on user behavior matches its stated purpose

This requires instrumentation at the application layer, not just the model layer. If your AI system recommends content, you need to track not just what it recommends, but how users' subsequent behavior changes—and whether those changes align with manipulation patterns.

Mistake 3: Relying on Pre-Deployment Assessment Alone

Why it happens: Compliance teams treat Article 5 like a gate before production. Pass the assessment, deploy the system, move on.

The consequence: Your AI system's behavior drifts. The model you assessed isn't the model running in production three months later—especially if you're doing continuous retraining. A system that was compliant at launch can cross into prohibited territory as it learns from production data.

The fix: Implement continuous compliance validation, not just continuous monitoring. This means:

  • Re-running your Article 5 assessment whenever you retrain models or modify system behavior
  • Establishing thresholds that trigger mandatory review (e.g., if feature importance shifts by more than a defined percentage)
  • Maintaining an audit trail that links each production model version to its compliance assessment

This isn't about perfection—it's about knowing when you need to stop and reassess. Define your trigger conditions now, before you're debugging a compliance issue in production.

Mistake 4: Treating the European Commission's Guidelines as Complete Documentation

Why it happens: Teams read the February 2025 guidelines, map them to their systems, and consider themselves compliant.

The consequence: The guidelines clarify intent and provide examples, but they don't cover every edge case. More importantly, they represent the Commission's interpretation at a single point in time. As enforcement actions emerge and case law develops, the practical boundaries of each prohibition will shift.

The fix: Build a living interpretation framework, not a static compliance document. For each prohibition relevant to your systems:

  • Document your interpretation and the reasoning behind it
  • Track enforcement actions and regulatory guidance updates
  • Schedule quarterly reviews to reassess your interpretation
  • Maintain a decision log that captures why you classified specific capabilities as compliant or prohibited

When regulators question your compliance, they won't just ask whether you followed the rules—they'll ask whether you had a reasonable process for interpreting them. Your decision log is that evidence.

Mistake 5: Separating Article 5 Compliance from Your Broader AI Governance

Why it happens: Article 5 has its own enforcement timeline and penalty structure, so teams treat it as a separate compliance workstream.

The consequence: You build redundant processes. Article 5's prohibitions overlap with requirements throughout the AI Act—particularly the transparency and human oversight requirements for high-risk systems. If you're assessing whether your system manipulates users, you're also assessing whether it needs enhanced transparency under other articles.

The fix: Integrate Article 5 assessment into your risk classification process. When you evaluate whether a system is high-risk, simultaneously evaluate whether it approaches any Article 5 prohibitions. Use the same evidence base, the same documentation, and the same review cadence.

This consolidation isn't just efficient—it's more accurate. A system that's borderline on an Article 5 prohibition is probably also borderline on risk classification. Assessing them together gives you a complete picture.

Prevention Checklist

Before deploying any AI system in the EU market:

  • Document how each AI capability influences user decisions or behavior
  • Identify which user characteristics (demographic, psychological, situational) the system considers
  • Assess whether the system creates information asymmetries or exploits vulnerabilities
  • Establish monitoring for behavioral patterns, not just technical performance
  • Define triggers that require compliance reassessment (model retraining, feature changes, deployment context shifts)
  • Create a decision log documenting your Article 5 interpretation and reasoning
  • Schedule quarterly reviews of regulatory guidance and enforcement actions
  • Integrate Article 5 assessment into your risk classification workflow
  • Verify that users can understand and contest AI-influenced decisions
  • Confirm that your audit trail links each production model to its compliance assessment

Article 5 isn't ambiguous because the EU wanted to be vague—it's principle-based because prohibited AI practices can't be defined purely in technical terms. Your compliance process needs to match that reality. Build the interpretive framework now, before you're explaining a violation to regulators.
